1. Acceptance

By installing and using the Aisthetix Virtual Try-On Shopify App ("the App"), you agree to these Terms. If you do not agree, do not install the App.

2. Description of Service

The App adds a virtual try-on widget to your Shopify storefront; customers upload a photo and see themselves wearing your products. Results are AI-generated and illustrative only.

3. Subscription and Billing

• Billing is handled via the Shopify Billing API; you are charged per the plan you select.
• A free plan is available at no cost and includes 10 try-ons per month. It requires no payment method and carries no trial and no usage charges.
• Each paid plan includes a 30-day free trial, capped at 50 try-ons. The trial ends when either the 30 days or the 50 try-ons run out, whichever comes first. After the trial you are billed every 30 days ($24.99 Starter, $49.99 Growth, $149.99 Business, USD).
• Each paid plan includes a fixed number of try-ons per month (150 Starter, 300 Growth, 1,000 Business).
• Try-ons beyond the included quota are billed as usage charges at $0.18 each on Starter, $0.14 on Growth and $0.10 on Business. Usage charges are capped: Shopify asks you to approve a maximum monthly amount when you subscribe, and you are never charged above the cap you approved. When the cap is reached the widget stops processing until the next billing period or until you raise the cap.
• Subscriptions created before usage charges were introduced have no usage line item. They keep the previous behaviour, where the widget stops at the included quota, until you approve a new subscription by changing plan.
• Subscriptions renew monthly; you may cancel at any time from your Shopify admin.
• Refunds are subject to Shopify's billing policies.

4. Acceptable Use

You must not:

• Use the App for unlawful purposes.
• Attempt to circumvent quotas or billing mechanisms.
• Upload offensive, illegal, or third-party infringing images.
• Resell or sublicense access to the App.

5. AI-Generated Results

Results produced by the App are AI approximations only. We make no warranty of accuracy, realism, or suitability, and results are not a guarantee of real-life appearance.

6. Data Protection

Your customers' personal data is handled as described in our Privacy Policy. With respect to storefront behavioural events processed through the App, you act as the data controller and Aisthetix acts as your processor, processing that data only on your behalf to provide the effectiveness-metrics service, applying appropriate security measures, and assisting with data-subject requests via Shopify's mandatory privacy webhooks.

7. Availability

We target high availability but do not guarantee uninterrupted service. We may perform maintenance, release updates, or discontinue features with reasonable notice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Aisthetix is not liable for any indirect, incidental, special, or consequential damages, including lost revenue, lost profits, or loss of data, arising from your use of the App.

9. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
